These Terms of Service ("Terms") apply to your use of Krira Augment, our APIs, and other AI infrastructure services (collectively, "Services"). These Terms form an agreement between you and Krira Labs, headquartered in Pune, India. By using our Services, you agree to these Terms.
1. Registration and Access
- Minimum Age:You must be at least 18 years old to use our Services. If you are under 18, you are strictly prohibited from using the Services.
- Registration:You must provide accurate and complete information to register for an account. You may not share your account credentials or make your account available to anyone else. You are responsible for all activities that occur under your account.
- Corporate Use:If you create an account on behalf of a company or organization, you represent that you have the authority to accept these Terms on their behalf.
2. Using Our Services
What You Can Do:
Subject to your compliance with these Terms, you may access and use our Services for your internal business purposes.
What You Cannot Do:
You may not use our Services for any illegal, harmful, or abusive activity. Prohibited activities include:
- Using the Services to infringe, misappropriate, or violate anyone’s rights.
- Reverse engineering, decompiling, or discovering the source code or underlying components of our Services (except to the extent this restriction is prohibited by applicable law).
- Using our outputs to develop models that compete with Krira Labs.
- Automatically extracting data (scraping) or bypassing rate limits.
- Representing that AI-generated Output was human-generated when it was not.
3. Content and Ownership
- Your Content:You may provide input to the Services ("Input"), such as prompts, documents, and datasets. You receive output based on the Input ("Output"). Input and Output are collectively "Content."
- Ownership:As between you and Krira Labs, you retain all ownership rights in your Input and you own the Output. We hereby assign to you all our right, title, and interest in and to the Output.
- Our Use of Content:We may use Content to provide, maintain, and improve our Services (e.g., debugging API errors). We do NOT use your proprietary Content (documents or RAG datasets) to train our core foundation models without your explicit consent.
- Accuracy:Artificial intelligence is probabilistic. You acknowledge that Output may not always be accurate ("Hallucinations"). You should not rely on Output as a sole source of truth or factual information.
4. Paid Accounts and Billing
- Billing: If you purchase any Services, you agree to provide complete and accurate billing information. For paid subscriptions, we will automatically charge your payment method on each renewal date.
- Taxes: You are responsible for all applicable taxes (including GST/VAT).
- Cancellation: You can cancel your paid subscription at any time. Payments are non-refundable, except where required by law.
- Price Changes: We may change our prices from time to time. If we increase subscription prices, we will give you at least 30 days’ notice.
5. Termination and Suspension
We are free to terminate or suspend your access to our Services immediately if we determine:
- You breached these Terms.
- We must do so to comply with the law.
- Your use of our Services causes risk or harm to Krira Labs, our users, or third parties.
6. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICES, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.
7. Limitation of Liability
NEITHER WE NOR OUR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR $100 USD (OR EQUIVALENT IN INR).
8. Indemnification
If you are a business or organization, you agree to indemnify and hold harmless Krira Labs, its affiliates, and personnel from and against any costs, losses, liabilities, and expenses (including attorneys’ fees) arising out of or relating to your use of the Services, Content, or any violation of these Terms.
9. Dispute Resolution and Governing Law
- Mandatory Arbitration:Any dispute arising out of or relating to these Terms or our Services shall be resolved through final and binding arbitration in Pune, India, in accordance with the Arbitration and Conciliation Act, 1996.
- Class Action Waiver:You and Krira Labs agree that disputes must be brought on an individual basis only, and may not be brought as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
- Governing Law:These Terms shall be governed by the laws of India. You consent to the exclusive jurisdiction of the courts located in Pune, Maharashtra for any legal action.
10. Trade Controls
You must comply with all applicable trade laws, including sanctions and export control laws. Our Services may not be used in or for the benefit of any embargoed country or restricted entity.
11. General Terms
- Assignment: You may not assign these Terms without our prior written consent. We may assign our rights to any affiliate or successor.
- Entire Agreement: These Terms contain the entire agreement between you and Krira Labs regarding the Services.
- Changes: We may update these Terms from time to time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
